Terms and Conditions

1. Interpretations

1.1 In these Terms and Conditions:

  • “Company” refers to LBRC LTD trading as Lyme Bay RIB Charter (LBRC)
  • “Customer” refers to any individual or entity booking or participating in services.
  • “Services” refers to all activities, charters, and courses offered by LBRC.
  • “Booking” refers to the act of reserving a service.
  • “Agreement” refers to these Terms and Conditions.
  • “We or us” refers to LBRC LTD, its employees, agents and contractor

2. General Conditions

2.1 By making a booking with LBRC, you confirm that you have read, understood, and agreed to these Terms and Conditions. Group bookings require the lead passenger to ensure all passengers have read and agree with the Terms and Conditions.

2.2 These Terms are governed by English Law, with disputes being subject to the exclusive jurisdiction of the courts of England and Wales. If any provision of these Terms and Conditions is held to be invalid or unenforceable by any judicial or other competent authority, all other provisions of these Terms and Conditions will remain in full force and effect and will not in any way be impaired.  If any provision of these Terms and Conditions is held to be invalid or unenforceable but would be valid or enforceable if some part or parts of these Terms and Conditions were deleted, the term and/or condition in question shall apply with the minimum modification necessary to make it valid and enforceable.

2.3 West Bay harbour and pontoon are managed by Dorset Council. LBRC is not liable for incidents occurring in these areas.

2.4 LBRC operates from facilities managed by Dorset Council. LBRC is not responsible for incidents occurring within harbour facilities not under its control.

3. Bookings, Payments and Cancellations

3.1 Bookings with LBRC can be made by telephone, email or via our website.  Bookings are confirmed on receipt of full payment.

3.2 All passengers must purchase a ticket before boarding the vessel. Anyone attempting to board without a valid ticket may be asked to leave the vessel and surrounding area.

3.3 Tickets can be purchased individually, or you can hire an entire vessel for an exclusive experience (referred to as a ‘Private Charter’). Each boat has a maximum capacity of 12 passengers, including any third-party tour guides.”

3.4 No ticket/booking may be resold without the previous written consent of LBRC. If LBRC reasonably believes that a ticket has been resold without such consent, the holder may be refused entry to or ejected from the vessel without payment of compensation

3.5 All prices are subject to change without notification.

3.6 Cancellations:

General RIB Rides

  • Free cancellations & date changes: Allowed up to 48 hours before the tour (pending availability).
  • No refunds: For cancellations made within 48 hours of the tour or once the tour has started.
  • If LBRC Cancels: We reserve the right to postpone or cancel trips if conditions are deemed unsafe. In the event of cancellation, we will notify you at the earliest opportunity and offer either a rebooking or refund.

Charters

  • Refundable deposit: If cancelled with at least 5 days’ notice.
  • Deposit forfeited: If cancelled with less than 5 days’ notice or if you miss the departure.

3.7 All passengers must arrive/check-in at the LBRC pontoon 20 minutes prior to their trip time to allow for lifejacket fitting and preparation for a timely departure.

3.8 Passengers are responsible for checking they arrive at the correct departure pier/point for their trip. No refunds or reschedules will be issued for missed trips.

3.9 If passengers miss their scheduled departure time, their booking will be cancelled, and they won’t be eligible for a rescheduled trip or refund.

3.10 LBRC are not responsible for factors that may lead to a passenger missing their trip, including; transport delays, weather conditions, parking issues and illness, and no refunds or reschedules will be given.

3.11 Due to the nature of the business, sailing times cannot be guaranteed, however we will make every reasonable effort to ensure LBRC operates as scheduled.

3.12 LBRC reserves the right, at our sole discretion and without prior notice, to cancel any trip for safety reasons or other circumstances. In the event of a cancellation, LBRC will issue a full refund for any prepaid tickets but will not be liable for any additional costs, including travel or other out-of-pocket expenses.

3.13 LBRC reserve the right to change the vessel the party is booked onto, this will not affect passenger numbers or experience/transfer times.

3.14 In the unlikely event the vessel has to make an emergency return to West Bay (or any other landing point along the route) LBRC will not be liable for replacement tickets and/or refunds.

3.15 LBRC will not be liable for any expense, loss of time, disappointment, inconvenience, or any other consequential loss suffered by the passenger in the event of a cancellation or postponement of a booking.

4. Private Charter and Transfers

 4.1 All vessels will be hired on a ‘Private Charter’ basis. The maximum number of passengers allowed per boat is twelve

4.2 A vessel may only be privately chartered by persons aged 18 years or over.

5. Gift Vouchers

5.1 Gift vouchers can be purchased on an individual or charter basis online.

5.2 Ensure to pre-book by telephone to avoid disappointment.

5.3 All vouchers are valid for a full 12 months from the purchase date.  In exceptional circumstance, an extension may be considered, this is at the discretion of LBRC.

5.4 Reseller/Third party/Agent vouchers will expire as per their booking terms and conditions.

5.5 All vouchers are non-refundable.

6. Children/Minimum Age

6.1 Minimum age for all trips is 5 years, with an adult, in flat calm seas.

6.2 Age limit may increase based on wind and wave conditions at the Skipper’s discretion.  The Skipper’s decision is final.

6.3 Children aged 5–11 are included in this policy to minimize risks of back, spinal, or shaking injuries.

6.4 A child is considered anyone 11 years or younger

6.5 All children under the age of 16 must be accompanied by an adult, at all times, whilst on the vessel and the pontoon.

6.6 Children between the ages of 16 but under 18 are permitted as passengers subject to, if requested by LBRC and/or its employees and/or its agents, proof of age.

 7. Minimum Numbers

 7.1 All trips require a minimum of 6 seats sold (or the cost equivalent of 6 seats) except at the absolute discretion of LBRC.

7.2 If a vessel does not meet this minimum, the trip will be rescheduled. Affected passengers will be contacted to arrange an alternative date and/or time.

8. Clothing

 8.1 Our RIB is open to the elements, we go out in most weathers, including the rain, it is recommended you “dress for the weather”.

8.2 For comfort and hygiene, all passengers must wear at least a T-shirt or suitable clothing underneath their lifejacket, bare torsos are not permitted.

8.3 Footwear isn’t essential but advised – no heels or muddy shoes.

8.4 It’s always colder at sea, even in the summer jacket/jumper/hoodie is ideal for the longer trips. A windproof/waterproof jacket is advised.

8.5 LBRC reserves the right to refuse entry onto the vessel if a passenger does not have suitable clothing and refunds are wholly at the discretion of LBRC.

9. Storage

9.1 Lockers under the seats are available for small backpacks. Lockers are not guaranteed to be fully watertight. We advise against bringing valuables onboard.

9.2 We are unable to accommodate larger items such as suitcases, wheelchairs or buggies

9.3 LBRC is not responsible for lost, stolen, or damaged items.

 10. Suitability to travel

10.1 Passengers participate at their own risk, except where injury or loss arises from LBRC’s negligence.  LBRC is not liable for injuries or conditions aggravated by the trip.

10.2 This trip is not suitable for:

  • Pregnant individuals
  • Anyone with current or past conditions affecting the neck, back, spine, hips, knees, or similar areas, musculoskeletal issues, reduced bone density, or any condition that may affect safe participation.
  • Anyone with other medical conditions that could make them unsuitable as a passenger.

Please note: Riding on a RIB involves exposure to force, shock, load, and compression, which may not be suitable/safe for everyone. Please contact us if you have any questions regarding suitability to travel.

  • Passengers must be able to step safely between the pontoon and the vessel, hold onto handholds throughout the journey and follow instructions.
  • Anyone under the influence of alcohol or drugs will be denied boarding.

10.3 Boat rides can involve sudden movements that may aggravate/worsen existing medical conditions. It is essential to inform us of any relevant health conditions or disabilities that could impact the skipper’s decision to carry you as a passenger. This includes, but is not limited to, epilepsy, dizzy spells, diabetes, angina, heart conditions, back or spinal issues, and pregnancy.

10.4 Safety and comfort are our top priorities.  If there are any queries/concerns over suitability to travel, please get in touch, our staff will happily discuss and advise

10.5 LBRC Ltd shall not be liable for personal injury, injury to others, or loss/damage except where caused by LBRC’s negligence.

10.6 Passengers with medical conditions must inform LBRC before booking. Refunds are not issued for illness-related disembarkations.

10.7 If any passenger suffers an injury or illness during a trip, it is their full responsibility to let the Skipper know before they leave the

11. Safety

11.1 Passengers must follow all safety instructions.

11.2 The skipper is responsible for the safety of the vessel and all passengers. The skipper’s decisions regarding seating, route, speed, passenger suitability, and the continuation or termination of a trip are final.

11.3 It is mandatory for all passengers to wear a lifejacket on board our RIB.  Crew will issue and fit all lifejacket

11.4 A £20 rearming fee applies for non-emergency inflation of lifejackets without the Skipper’s instruction.

11.5 The skipper will deliver a full safety briefing before the trip departs.  Passengers must be able to listen to and understand the safety instructions.  If a written copy of the safety brief is required, please ask one of the team.

11.6 Passengers must remain seated at all times during their experience except when directly instructed by a representative of LBRC that it is safe to embark/disembark.

11.7 LBRC reserves the right to refuse service to passengers deemed unfit or disruptive.

11.8 Offensive behaviour, alcohol, or prohibited items are not allowed onboard.

12. Conduct

12.1 Passengers will not be allowed to board if LBRC determines that they:

  • 12.1.1 Have been convicted of a criminal offense that, in LBRC’s opinion, could impact the safety or enjoyment of other passengers.
  • 12.1.2 Have behaved, or are likely to behave, in a way that could compromise the safety or enjoyment of others.
  • 12.1.3 Have used threatening, abusive, or offensive language or behaviour, or have acted in a way that could disturb the peace.
  • 12.1.4 Have been disrespectful, aggressive, or abusive toward passengers, staff, or crew.

12.2 Passengers are not allowed to bring offensive weapons, dangerous items, or alcohol onto the vessel. All passengers and their belongings may be subject to a search if requested.

12.3 It is strictly prohibited to bring dangerous items aboard, including fireworks, smoke bombs, glass bottles, or flammable liquids or other articles which may cause injury. Throwing objects from the vessel is also strictly forbidden.

12.4 Smoking and vaping are strictly prohibited on the vessel itself and on the pontoon leading to the vessel.

12.5 Pets are not permitted onboard.

12.6 Loud noises (such as music from radios or other devices) and any disruptive behaviour that could annoy other passengers or cause confusion are not allowed onboard or in the boarding area.

12.7 LBRC requests passengers are respectful of our staff, other passengers and neighbours. Whilst onboard please refrain from offering obscenities, profanities or any indecent hand/body gestures to members of the public or other harbour users.

12.8 No food or drinks may be consumed on the boat or boarding platform without prior permission from LBRC.

12.9 Other than liability for death or personal injury resulting from LBRC LTD’s negligence, LBRC, its employees or agents shall not be liable for any loss or damage, direct or indirect, however arising, including without limitation any distress, inconvenience or anxiety caused during the course of any trip undertaken and/or during evacuation from the vessel in the event of breakdown or accident.

13. Weather

13.1 All trips are subject to weather and sea conditions: LBRC reserves the right to postpone or cancel trips if conditions are deemed unsafe.  In the event of cancellation, we will notify you at the earliest opportunity and offer either a rebooking or refund.

13.2 Refunds are only offered if no alternative trip is provided.

13.3 LBRC reserves the right to deviate from a vessel’s planned route when necessary. Weather and tides may occasionally cause delays or changes to the advertised route. Whenever possible, passengers will be informed of any modifications before departure.

13.4 LBRC cannot be held responsible for weather conditions during the experience. Without exception, poor weather will not be deemed a valid reason to authorise relocation of any booking.

13.5 LBRC is not liable for weather-related trip alterations or cancellations.

14. Force Majeure

 LBRC shall not be liable for cancellation, delay, or alteration to any booking caused by circumstances beyond its reasonable control. This includes but is not limited to severe weather, harbour closure, mechanical failure, emergency services instruction, port authority restrictions, or government regulation.

15. Liability and Insurance

15.1 LBRC holds appropriate insurance but accepts no liability for personal loss, injury, or damage unless due to its negligence.

15.2 Passengers are advised to secure personal insurance where necessary.

15.3 LBRC is not responsible for lost or damaged belongings.

16. Complaints and Feedback

16.1 Complaints should be reported to crew or skippers immediately.

16.2 Formal complaints must be submitted in writing within seven days to office@lymebayribcharter.co.uk

16.3 LBRC aims to respond within 10 working days.

17. Photography and Media

17.1 LBRC and authorized third parties may capture images or videos for promotional purposes. By booking, passengers consent to such use.

17.2 Passengers may take personal photographs but do so at their own risk.

By making a booking, the Customer acknowledges and agrees to these Terms and Conditions.
